Regulatory policy is one of the core policy measures for governments to achieve its social or economic objectives through the use of law, regulations, and other instruments. It is often subjected to the scheme of reform efforts aiming to improve the quality of government regulation that would shift unnecessary obstacles to fair competition, innovation and growth, and thus improve the citizens’ quality of life. A glance into the background of regulatory reform highly represents the current status of society and the perspectives on future directions where it is heading towards.

The financial and fiscal crisis followed by signs of stagnation, as well as accumulating environmental challenges around the world has set off the alarm to the government for better policy reforms. Among others, a need for sound regulatory framework is being highlighted as a basic condition to revive the economy and for well-functioning societies. The Korean government has been making concerted efforts in the area of regulatory reform, placing the objective as the core of its national strategy in order to boost its economic growth and create employment.

The Recommendation of the OECD Council on Regulatory Policy and Governance was adopted in March 2012. Through the recommendation, OECD members agreed to adhere to principles of open government, including transparency and participation in the regulatory process to ensure that regulation serves the public interest and is informed by the legitimate needs of those interested in and affected by regulation. This includes providing meaningful opportunities (including online) for the public to contribute to the process of preparing draft regulatory proposals and to the quality of the supporting analysis. Governments should ensure that regulations are comprehensible and clear and that parties can easily understand their rights and obligations.

Regulations are considered to be the most effective policy measures for sustaining economic growth and addressing economic imbalances without imposing excessive fiscal requirements on the current or future society. However, a systemic approach in assessing the positive and negative impacts of regulations is important to maximize the benefits of regulations and to justify the cause of such policies to the people whose lives and businesses are directly and/or indirectly influenced.
